ANTHONY J. BOLOGNESE

Anthony J. Bolognese is the founding principal of Bolognese & Associates, LLC. Mr. Bolognese is a graduate of St. Joseph's University (B.A. 1979) and Temple University School of Law (J.D. 1982), where he served on the Editorial Board of the Temple Law Review. Mr. Bolognese served as law clerk for the Honorable Raymond J. Broderick of the United States District Court for the Eastern District of Pennsylvania, and for the Honorable Francis L. Van Dusen of the United States Court of Appeals for the Third Circuit. Mr. Bolognese is a member of the American, Pennsylvania and Philadelphia Bar Associations, and of the American Bar Association's Antitrust and Litigation Sections. Mr. Bolognese is a member of the Bar of the Supreme Court of Pennsylvania, and has been admitted pro hac vice in federal courts nationally.

Mr. Bolognese is honored to serve as a member of the Board of Trustees of the Philadelphia Bar Foundation, the charitable arm of the Philadelphia Bar Association, which awards grants to law-related programs in the Philadelphia area that assist the indigent, elderly and disabled, and others in need of legal assistance.

Mr. Bolognese has had extensive experience as counsel in complex commercial litigation in state and federal courts throughout the nation, with a particular concentration and emphasis in individual and class action litigation under the state and federal antitrust laws. Mr. Bolognese has also represented plaintiffs and defendants in a broad range of other other domestic and international commercial litigation, including breach of contract litigation, litigation involving claims for coverage and indemnification under Directors and Officers liability insurance policies: bad faith denial or delay of insurance benefits, disputes involving business torts and other unfair and deceptive business practices (including claims such as fraud, misappropriation of trade secrets, corporate espionage, violation of restrictive covenants, and tortious interference with business opportunities), disputes involving partnerships and closely held companies and claims involving alleged breach of fiduciary duty and misuse of corporate assets by corporate officers and directors.

Mr. Bolognese is also a frequent lecturer on class actions, discovery issues (including in the rapidly evolving area of electronic discovery), trial advocacy, class actions, and developments in antitrust law.

Mr. Bolognese has served as Court-appointed Lead Counsel for the plaintiffs in many of the most substantial federal antitrust actions of the past decade which have resulted in substantial court approved recoveries, including: EPDM Antitrust Litigation (D. Conn.)(court approved recoveries exceeding $100 million); Hydrogen Peroxide Antitrust Litigation, (E.D. Pa.)($97 million); Alco Industries, Inc. v. DuPont Dow Elastomers, LLC, ($36 million); Polychloroprene Rubber (CR) Antitrust Litigation, (D. Conn.)($15 million; MMA Antitrust Litigation, (E.D. Pa.) ($15 million); Mercedes-Benz Antitrust Litigation, ($17 million); and Cotton Yarn Antitrust Litigation,  (M.D.N.C.)($7.8 million).

Mr. Bolognese has been honored with Martindale-Hubbell's designation as an "AV" rated attorney, the highest rating available to any individual lawyer, and a designation that is reserved for those who have achieved the height of professional excellence in terms of legal ability and adherence to the highest ethical standards.

More recently, Mr. Bolognese was honored to be named a  2011 “Super Lawyer” by Thomson Reuters, the world’s leading source for intelligent information for businesses and professionals, in recognition of his accomplishments and professional standing among his peers in the area of antitrust law. The Super Lawyer designation is an honor reserved for a highly select group of attorneys who are recognized by their peers as leading practioners in their particular practice area. Recognition as a Super Lawyer is the result of a rigorous process of evaluation that includes a statewide survey of over 30,000 lawyers who are asked to evaluate the professional standing of a slate of leading attorneys in various practice areas, based on first hand observation and reputation, and the results of that survey are further refined through a highly rigorous independent evaluation of the candidates’ expertise, accomplishments and professional standing. Fewer than 5% of all attorneys statewide are honored with a Super Lawyer designation.

Mr. Bolognese was also named as one of Philadelphia’s Best Lawyers for 2011 by the Legal Intelligencer, the leading daily legal newspaper in the Philadelphia metropolitan area. The “Best Lawyers” designation is an honor that is bestowed upon a very select group of lawyers who have excelled in their practice area, based on a comprehensive survey or practitioners and other members of the legal community. Mr. Bolognese’s designation as a Super Lawyer is further recognition that he has distinguished himself not only by the results he has achieved in the courtroom, but also by the first hand observation of the attorneys with and against whom he has litigated cases.

Mr. Bolognese has served with distinction in many of the most substantial federal antitrust cases of the last decade.  His accomplishments have not gone unnoticed by the Courts before which he has appeared.  Chief Judge Donald E. Ziegler of the United States District Court for the Western District of Pennsylvania, presiding over a case in which Mr. Bolognese had significant leadership responsibility, recently observed that "plaintiffs' counsel are lawyers with extensive experience in antitrust and multiparty litigation," and held "without hesitation" that plaintiffs' counsel had adequately represented the interests of their clients. See In re Flat Glass Antitrust Litigation, 191 F.R.D. 472, 480 (W.D.Pa. 1999). The Court went so far as to observe that "[t]he Court is fortunate to have the assistance of able lawyers" to address the complexities of that case. 191 F.R.D. at 489.

Similarly, in another antitrust action in which Mr. Bolognese served as a Co-Lead Counsel, the Court in approving the settlement of that case stated that that "the Plaintiff Class members were well served by attorneys who were highly experienced and nationally recognized in class action litigation generally and anti-trust litigation in particular. . . . . Plaintiff Class counsel['s] . . . work was efficiently conducted. Counsel diligently developed the facts and legal issues, analyzed a multitude of documents, were steadfast in settlement negotiations with the . . . Defendants, and, ultimately, achieved an excellent result." In re Residential Doors Antitrust Litigation, 1998 WL 151804, at p. 8 (E.D.Pa. 1998).

In re Ethylene Propylene Diene Monomer (EPDM) Antitrust Litigation, MDL No. 1542 (D. Conn.), an antitrust action brought on behalf of purchasers of EPDM, the third largest synthetic rubber consumed worldwide, which resulted in total recoveries exceeding $100 million.

In re Hydrogen Peroxide Antitrust Litigation, Civil Action No. 05-666 (E.D. Pa.), an antitrust action brought on behalf of purchasers of hydrogen peroxide and related products, which resulted in total recoveries exceeding $97 million.

Alco Industries, Inc. v. DuPont Dow Elastomers, LLC, Case No. 1:04 CV 00588 (D.D.C.), an antitrust action brought on behalf of purchasers of Polychloroprene ("CR"), a synthetic rubber product, which resulted in total recoveries exceeding $36 million.


In re Polychloroprene Rubber (CR) Antitrust Litigation, 3:05-MD-01642 (D. Conn.), a related antitrust action brought against additional defendants, resulting in  additional recoveries exceeding $15 million.

In re Methyl Methacrylate (MMA) Antitrust Litigation, 2:06-md-01768 (E.D. Pa.), an antitrust action brought on behalf of purchasers of methyl methacrylate (MMA) and polymethyl methacrylate (PMMA), which resulted in total recoveries exceeding $15 million.

In re Mercedes-Benz Antitrust Litigation, Master File No. 99-431 (AMW) (D.N.J.), an antitrust action brought on behalf of persons who purchased and leased new Mercedes-Benz automobiles, which resulted in total recoveries exceeding $17 million. 

In re Cotton Yarn Antitrust Litigation, 1:04 MDL No. 1622 (M.D.N.C.), an antitrust action brought on behalf of purchasers of cotton yarns, which resulted in total recoveries exceeding $7.8 million.


In re Flat Glass Antitrust Litigation, MDL No. 1200, Master File No. 97-550 (W.D. Pa.), an antitrust action brought on behalf of purchasers of flat glass products which settled for over $120 million.

In re Residential Doors Antitrust Litigation, Master File No. 94-CV-3744, MDL No. 1039 (E.D. Pa.), an antitrust action brought on behalf of purchasers of residential doors which resulted in a settlement of over $14 million.
